Chutney Festival Vendor and Volunteer Application Terms and Conditions
Introduction
Welcome to the Chutney Festival! These Terms and Conditions (the “Terms”) apply to all vendors (“Vendor”, “you”, “your”) and volunteers (“Volunteer”, “you”, “your”) who wish to participate in the Chutney Festival (the “Festival”) by filling out an application on the Chutney Festival website (the “Website”). By submitting an application, you agree to comply with and be bound by these Terms.
Application Process
- Eligibility: Vendors and volunteers must submit a completed application form, including all required documents and information, to be considered for participation in the Festival.
- Acceptance: The submission of an application does not guarantee acceptance. The Festival organizers (“Organizers”) reserve the right to accept or reject any application at their sole discretion.
- Application Fee: If applicable, a non-refundable application fee must be submitted with the vendor application. The amount and payment instructions will be specified on the Website. There is no fee for volunteer applications.
- Deadline: Applications must be submitted by the deadline specified on the Website. Late applications may not be considered.
Vendor Obligations
- Compliance: Vendors must comply with all applicable laws, regulations, and Festival rules and guidelines, including health and safety regulations.
- Insurance: Vendors are required to have appropriate insurance coverage, including but not limited to general liability insurance. Proof of insurance must be provided upon request.
- Permits and Licenses: Vendors must obtain and display all necessary permits and licenses required to operate at the Festival.
- Booth Setup and Operation: Vendors are responsible for the setup, operation, and teardown of their booths. Booths must be staffed and operational during all Festival hours.
- Product Quality and Safety: Vendors must ensure that all products sold or distributed at the Festival are safe, high-quality, and comply with all relevant standards and regulations.
Volunteer Obligations
- Compliance: Volunteers must comply with all applicable laws, regulations, and Festival rules and guidelines, including health and safety regulations.
- Roles and Responsibilities: Volunteers will be assigned specific roles and responsibilities by the Organizers. Volunteers are expected to perform their duties as assigned and to the best of their ability.
- Time Commitment: Volunteers must adhere to the schedule provided by the Organizers and must be punctual and reliable.
- Conduct: Volunteers must conduct themselves in a professional and respectful manner at all times. Harassment, discrimination, or disruptive behavior will not be tolerated.
Fees and Payment
- Booth Fees: Accepted vendors will be required to pay a booth fee, the amount of which will be specified on the Website. Booth fees are due by the date specified in the acceptance notification.
- Payment Methods: Payment must be made through the methods specified on the Website.
- Refunds: Booth fees are non-refundable, except in cases where the Festival is cancelled by the Organizers.
Festival Conduct
- Behavior: Vendors and volunteers must conduct themselves in a professional and respectful manner at all times. Harassment, discrimination, or disruptive behavior will not be tolerated.
- Cleanliness: Vendors and volunteers must maintain the cleanliness of their designated areas. Waste must be disposed of properly.
- Prohibited Items: The sale or distribution of illegal items, hazardous materials, or any items deemed inappropriate by the Organizers is strictly prohibited.
Liability and Indemnity
- Liability: The Organizers are not liable for any loss, damage, or injury incurred by Vendors, Volunteers, or their representatives while participating in the Festival.
- Indemnity: Vendors and Volunteers agree to indemnify and hold harmless the Organizers, their affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, and expenses arising from their participation in the Festival.
Miscellaneous
- Amendments: The Organizers reserve the right to amend these Terms at any time. Vendors and Volunteers will be notified of any changes.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Festival is held.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Entire Agreement: These Terms constitute the entire agreement between the Vendor/Volunteer and the Organizers regarding the subject matter hereof and supersede all prior agreements and understandings.
By submitting an application, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
